objetivo es:<\/b><\/p>\n<p>Que cuando te cases, sin necesidad de:<\/p>\n<ul>\n<li>Comunic\u00e1rselo a tu c\u00f3nyuge<\/li>\n<li>Sin tener que ir al notario<\/li>\n<\/ul>\n<p>Te cases en todo el territorio nacional en Separaci\u00f3n de bienes, en vez de en gananciales<\/p>\n<p>Y se modifique el art\u00edculo 1316, que aparece as\u00ed<\/p>\n<p><em><b>Art\u00edculo 1316 A falta de capitulaciones o cuando \u00e9stas sean ineficaces, el r\u00e9gimen ser\u00e1 el de la sociedad de gananciales.<\/b><\/em><b><\/b><\/p>\n<p>Por este articulado<\/p>\n<p>Si no existe pacto o si los cap\u00edtulos matrimoniales son ineficaces, el r\u00e9gimen econ\u00f3mico es el de separaci\u00f3n de bienes<\/p>\n<p><b>TITULO<\/b><\/p>\n<p><b>Porque cuando te cases, se haga siempre en separaci\u00f3n de bienes y no en bienes gananciales, sin tener que ir al notario y discutirlo con tu pareja.<\/b><\/p>\n<p><b>EXPLICACION<\/b><\/p>\n<p>Actualmente en Espa\u00f1a, salvo las CCAA de Catalu\u00f1a y Baleares, cuando te casas, se hace siempre directamente en Gananciales, y no en Separaci\u00f3n de Bienes.<\/p>\n<p>Esto que significa \u00a0que si quieres casarte en separaci\u00f3n de bienes, tienes que dec\u00edrselo a tu c\u00f3nyuge antes de casarte e indicarle-a que te quieres casar en separaci\u00f3n de bienes y no en gananciales, y adem\u00e1s tienes que ir al notario para hacer capitulaciones matrimoniales.<\/p>\n<p>La importancia es la siguiente de casarse de una forma o de otra es la siguiente: Si yo estoy casado una con una persona, que adquiere deudas, bien porque es empresario y el negocio le ha salido mal, bien porque es lud\u00f3pata, o tiene cualquier tipo de enfermedad, o bien porque acepta la herencia de su padre que tiene deudas,\u00a0 todas esas deudas no son\u00a0 del que las ha generado, sino del matrimonio, por lo que nos podr\u00edan embargar el patrimonio com\u00fan, la casa, el sueldo de mi pareja etc, pero si hay separaci\u00f3n de bienes nada de esto se produce.<\/p>\n<p>A su vez, si yo por ejemplo he heredado un importante patrimonio de mis padres, y tengo esos bienes alquilados, esa renta que generan los inmuebles alquilados, no es mi\u00f3 solo, sino del matrimonio.<\/p>\n<p>Lo que intentamos con esta iniciativa es sobre todo, ayudar a los emprendedores, empresarios, aut\u00f3nomos en definitiva trabajadores por cuenta propia a fin de que si su negocio sale mal, por cualquier causa, dichas deudas del negocio, no afecte a sus matrimonios, y por lo tanto nos les embarguen la casa, la nomina de su pareja etc.<\/p>\n<p>Parece muy sencillo hacer la separaci\u00f3n de bienes, antes de casarte, simplemente indic\u00e1ndoselo a tu pareja, pero la realidad es que esto no es as\u00ed, y para muestra los datos de Castilla y Le\u00f3n del a\u00f1o 2008 al a\u00f1o 2012 ha habido 41.973 matrimonios y solo 13.188 \u00a0tienen separaci\u00f3n de bienes, pero esto no nos indica si la separacion <b>de bienes se ha producido GENERALES<\/p>\n<p><em><b>Art\u00edculo 1315<\/b><\/em><b><\/b><\/p>\n<p>El r\u00e9gimen econ\u00f3mico del matrimonio ser\u00e1 el que los c\u00f3nyuges estipulen en capitulaciones matrimoniales, sin otras limitaciones que las establecidas en este C\u00f3digo.<\/p>\n<p><em><b>Art\u00edculo 1316<\/b><\/em><b><\/b><\/p>\n<p>A falta de capitulaciones o cuando \u00e9stas sean ineficaces, el r\u00e9gimen ser\u00e1 el de la sociedad de gananciales.<\/p>\n<p><em><b>Art\u00edculo 1317<\/b><\/em><b><\/b><\/p>\n<p>La modificaci\u00f3n del r\u00e9gimen econ\u00f3mico matrimonial realizado durante el matrimonio no perjudicar\u00e1 en ning\u00fan caso los derechos ya adquiridos por terceros.<b><\/b><\/p>\n<p><b>CODIGO CATALAN<\/b><br \/>\nLey 25\/2010, de 29 de julio, del libro segundo del C\u00f3digo civil de Catalu\u00f1a, relativo a la persona y la familia.<b><\/b><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Disposiciones_generales\"><\/span>Disposiciones generales<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><em><b>Art\u00edculo 231-10<\/b><\/em><b>\u00a0<\/b><b>R\u00e9gimen econ\u00f3mico del matrimonio<\/b><\/p>\n<p><b>1.<\/b>\u00a0El r\u00e9gimen econ\u00f3mico matrimonial es el convenido en cap\u00edtulos.<\/p>\n<p><b>2.<\/b>\u00a0Si no existe pacto o si los cap\u00edtulos matrimoniales son ineficaces, el r\u00e9gimen econ\u00f3mico es el de separaci\u00f3n de bienes.<\/p>\n<p>As\u00ed que lo que se pretende es modificar el art\u00edculo 1316, que ahora mismo esta as\u00ed redactado:<\/p>\n<p>\u201cA falta de capitulaciones o cuando \u00e9stas sean ineficaces, el r\u00e9gimen ser\u00e1 el de la sociedad de gananciales.\u201d<\/p>\n<p>Y que quede redactado de la siguiente forma, que es como lo esta el art\u00edculo 231 del c\u00f3digo civil catal\u00e1n:<\/p>\n<p>\u201cSi no existe pacto o si los cap\u00edtulos matrimoniales son ineficaces, el r\u00e9gimen econ\u00f3mico es el de separaci\u00f3n de bienes.<\/p>\n<p><b>OBJETIVO<\/b><\/p>\n<p><b>El objetivo es:<\/b><\/p>\n<p>Que cuando te cases, sin necesidad de:<\/p>\n<ul>\n<li>Comunic\u00e1rselo a tu c\u00f3nyuge<\/li>\n<li>Sin tener que ir al notario<\/li>\n<\/ul>\n<p>Te cases en todo el territorio nacional en Separaci\u00f3n de bienes, en vez de en gananciales<\/p>\n<p>Y se modifique el art\u00edculo 1316, que aparece as\u00ed<\/p>\n<p><em><b>Art\u00edculo 1316 A falta de capitulaciones o cuando \u00e9stas sean ineficaces, el r\u00e9gimen ser\u00e1 el de la sociedad de gananciales.<\/b><\/em><b><\/b><\/p>\n<p>Por
